GENERAL TERMS AND CONDITIONS
Quotations
1.1 All quotes are valid for thirty (30) days from the date of the quotation.
1.2 Unless specifically stated otherwise, all quotations are based on costs of labour and materials at the date of the quotation and is subject to price variation in the event of circumstances outside the control of BMD Projects Engineering.
1.3 The Client must communicate acceptance of the quotation before the project will be scheduled, this includes approval of drawings.
Agreement
1.1 Any instructions from the Client placing an order or accepting a quote shall constitute acceptance of these terms and conditions.
1.2 These terms and conditions may only be altered by agreement between the parties, in writing.
2.1 BMD Projects Engineering will provide the Service or Product to the Client, and the Client will pay the Price to BMD Projects Engineering for performing those Services or manufacturing those Products.
2.2 Any additional Service not covered in quoted costs will attract additional time, labour, and material charges at the current rate.
3.1 BMD Projects Engineering will render an invoice to the Client, which is to be paid within 7 days, unless otherwise stated on the invoice or written agreement.
3.2 Invoices that are not paid by the Client within 7 days (or the period specified on the invoice or written agreement) will be deemed a Payment Default.
3.3 Payment Defaults will be charged interest at a rate of 2.5% per 30 days until the date of payment.
3.4 Payment defaults that are 30 days or more overdue may be handed over for collection.
3.5 Any costs incurred by BMD Projects Engineering in obtaining payment of outstanding invoices, including legal costs and/or collection fees, will be for the account of the client.
“Client” shall mean the customer (or any person acting on behalf of and with the authority of the client) as described on any quotation, work authorization or other form as provided by BMD Projects Engineering to the client.
“Product” shall mean products supplied by BMD Projects Engineering to the Client (and where the context so permits shall include any supply of services) and are as described on the invoices, quotation, work authorization or any other forms as provided by BMD Projects Engineering.
“Services” shall mean all services supplied by BMD Projects Engineering to the Client and includes any advice or recommendations (and where the context so permits shall include any supply of product as defined above).
“Price” shall mean the price payable for the Products and or Services as agreed between BMD Projects Engineering.
